DEFENSE VERDICT FOR NIGHTCLUB IN
NEGLIGENT SECURITY/PREMISES LIABILITY MATTER
TAMPA, FL, - Quintairos, Prieto, Wood & Boyer, P.A. (QPWB), Quintairos, Prieto, Wood & Boyer, P.A. (QPWB) trial attorneys, Kenneth W. MacCollum and Robert A. Santa Lucia both of the Tampa office, achieved a defense verdict on behalf of The Dallas Bull, a Tampa nightclub where a patron suffered a serious compound fracture to the right wrist, requiring surgery. The case of Leonor Campoamor vs. The Dallas Bull was tried before the Honorable William Levens of the 13th Judicial Circuit of Hillsborough County, where after one week of trial, the jury deliberated for 15 minutes and returned a defense verdict finding no negligence on the part of the defendant.
The defense pointed to numerous inconsistencies with plaintiff’s testimony, and also introduced evidence indicating that the plaintiff’s back injuries were pre-existing.
Plaintiff asked the jury for a total award of $500,000. They argued that patrons participating in the dance should have been forewarned that the dance was inherently dangerous, or should not have allowed the dance at all. The defense contended that the dance was a customary form of entertainment among patrons at the establishment and that the nightclub had no history of prior problems with the “Gator Dance.” The jury awarded a total defense verdict on the issue of liability.
